1. Use of the Site
You may use this Site for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable law
- Engage in any conduct that may disable, damage, or interfere with the Site
- Use automated systems or software to extract data from the Site
2. Intellectual Property
All content on the Site — including but not limited to text, images, logos, and design — is the property of Surdyk’s Catering or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or modify any content without our prior written permission.
3. Product and Service Descriptions
We strive for accuracy in all service descriptions and pricing. However, we do not guarantee that all content is error-free, complete, or current. We reserve the right to correct any errors and to change or update information at any time without prior notice.
4. Orders and Payment
When you place an order through the Site, you agree to provide accurate, current, and complete information. All payments are due upon ordering, and we reserve the right to cancel or refuse any order at our discretion.
5. Cancellation Policy
At Surdyk’s Catering, every order—whether a delivery, pickup, or serviced event—requires advance preparation. This includes purchasing fresh ingredients, allocating kitchen and event resources, and scheduling staff. To ensure we can maintain the highest quality of service for all our clients, we have established a cancellation policy that reflects the time, planning, and commitment involved in fulfilling your order. Thank you for your understanding and support.
For Delivery or Pickup Orders:
Cancellations must be submitted more than one week (7 days) in advance for a full refund. Cancellations received after this time and up to 24 hours in advance are eligible for a 50% refund. No refunds will be given for cancellations made less than 24 hours in advance of event.
For Serviced Events:
Please refer to the terms outlined in your Catering Services Agreement.
6. Limitation of Liability
To the fullest extent permitted by law, Surdyk’s Catering is not liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your access to or use of the Site or services ordered through the Site.
7. Disclaimer of Warranties
The Site and all information provided are offered “as is” without any warranties, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or secure.
8. Indemnification
You agree to defend, indemnify, and hold harmless Surdyk’s Catering and its affiliates from any claims, damages, obligations, or expenses arising out of your use of the Site or violation of these Terms.
9. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Hennepin County, Minnesota.
10. Modifications
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site constitutes acceptance of the updated Terms.
